TN Visa

The TN (Trade NAFTA) category was developed as part of the North American Free Trade Agreement(NAFTA), to facilitate the entry of Mexican and Canadian citizens to the United States to be employed in professional business activities on a temporary basis.

Only certain specified occupations as specified in the NAFTA treaty can serve as the basis for TN employment.

Both Canadian and Mexican citizens can be admitted to the United States in TN status in increments of up to one year. Extensions of stay are also granted in up to one-year increments.

Professionals of Canada or Mexico may work in the United States on a TN visa if they fulfill the following criteria:
  • Applicant is a citizen of Canada or Mexico;
  • Profession is on the NAFTA list;
  • Position in the U.S. requires a NAFTA professional;
  • Mexican or Canadian applicant is to work in a prearranged full-time or part-time job, for a U.S. employer (see documentation required). Self employment is not permitted;
  • Professional Canadian or Mexican citizen has the qualifications of the profession

There is no limit to the number of times a Canadian or Mexican citizen can be granted TN visa status, provided the stay remains temporary in nature.
